Constitution of the World Human Powered Vehicle Association
The name of this organisation is World Human Powered Vehicle Association. It shall also be referred to as the WHPVA. It is a non-profit public-benefit association.
The World Human Powered Vehicle Association is an association of national associations and organisations, dedicated to promoting improvement, innovation and creativity in the use of human power, especially in the design and development of human-powered vehicles.
The WHPVA shall sanction or otherwise promote periodic competitions, where land, water and air vehicles may be showcased and tested. A world championship called «HPV World Championship» shall be held at minimum every 4 years, preferably every 2 years, and at minimum for land and water vehicles.
The WHPVA shall act as a sanctioning body for races and other sporting events, and for new records of human powered land and water vehicles set under the rules of the WHPVA. In all rules, regulations and executive decisions of the association, it shall be the overall philosophy and policy to stimulate competition and creativity. For other vehicle or competition types such as hybrid power, underwater, amphibious, ice, air or ground effect vehicles, or classical long-distance achievements, the WHPVA may adopt existing rules or competition types from other organisations or introduce its own new categories. The WHPVA shall review it own rules regularly and maintain them in accordance with current thinking.
The WHPVA shall keep historical records (dates, places, distances, times, speeds, characteristics of vehicles and names of athletes) of the results of speed-records and international competitions. The association shall serve as a source of information for official human powered land, water, underwater and air records and other outstanding achievements pertinent to the pursuit of human power.
Membership is reserved for all national human power vehicles organisations worldwide. The list of members is published on the WHPVA website. Each member, represented by one person on the membership board, shall designate its candidate to the chairman or chairwoman and officers of the WHPVA. A member is not liable for the liabilities or obligations of the association. Fees and dues for specific operations of the WHPVA, proposed by the board, shall be raised among the members individually and paid voluntarily. The suggested annual sums shall initially not exceed one Euro per each actual member of the specific national HPV organisation.
Any member may direct the board of directors to conduct a referendum of the members on any relevant matter. Each member shall have one vote. All such matters shall be decided by a majority of the votes received by the chair or secretary within 30 days after mailing, and shall be recorded and circulated by the association without delay.
Meetings of members are normally conducted via internet – e.g. email or other open, non-propietary internet resources – in the English language, but can also be carried out in person during world championships if this is decided in advance.
The membership of a member shall terminate at its request or if so decided by the board.
The WHPVA shall be governed by its board, the chairman or chairwoman and further officers. The respective names shall be published on the WHPVA website. Chair and officers shall serve without compensation.
Each member of the board shall be determined by the individual member of the WHPVA. The number of the members of the board is the number of members of the WHPVA. The term of office shall not be limited, except by the termination of membership.
Duties of the board members shall be to appoint and discharge the chair and officers, supervise their duties and decide on matters as presented. The chair shall be elected by the board from among the members of the national associations. He or she also represents his or her national organisation. The term is two years and renewable after this. The chair shall hold office until he or she resigns, is discharged, or until his or her successor is elected.
The chair shall supervise and control the affairs of the association and preside at all the discussions of the board. Further duties are to help establish clear and reasonable procedures for collecting and certifying records, petitions, referendums, amendments, additions or modifications of rules, regulations, funds, procedures and constitutional details and voting bases and procedures, initiate publication of the results in the respective sections of the WHPVA website. The chair shall establish, supervise and delegate authority to standing executive board committees as deemed necessary, with the approval of the board. Terms of the officers of these committees are two years and renewable after this. Officers may themselves be representatives on the board or be in addition to this. In the latter case they have no voting rights on the board.
Officers for the record committee shall collect, check and, after formal agreement by the board, certify records and vehicle events on land, water and air according to the rules of the WHPVA, appoint and advise assistants as necessary and assure that competition data and other information are properly recorded and transmitted to the webmaster of the WHPVA. A period of maximum 30 days from receiving the comprehensive applications to the initial decision must be respected. If this is negative and further information is supplied, the final decision must be decided within 30 days.
Officers for the rules committee shall collect, check, revise and, after formal agreement by the board of directors within 30 days by a majority of the votes received, integrate those amendments into the rules and assure that all modifications or amendments appear in the competition rules published on the WHPVA website. The published competition rules are effective and in force the following calender year or sooner if so decided by the board.
Amendments to this constitution may be proposed by any WHPVA member who presents to the board and chair the request in written form by mail, email, or another electronic resources in use by the board. The proposed amendment shall be discussed by the board and decided by a majority of the votes received by the chair or secretary within 40 days after mailing, and shall be recorded by the association and published on the website without delay.
The dissolution of the WHVA is initiated by presenting a ballot to the board of directors. An affirmative vote of two thirds returned within 30 days shall be required. In the event of dissolution, any fund or archives shall be donated to an organisation whose mission supports the purpose as defined in paragraph 1.
